At Onyx Games we firmly believe in importance of the personal data you have entrusted to us and believe that is our responsibility to properly manage, protect and process your personal data. This privacy policy is designed to assist you in understanding how we collect, use, disclose, transfer and/or process the personal data you have provided to us and/or possess about you, whether now or in the future. We use your data to exclusively provide and improve the Services. By using the Services, you agree to the collection and use of Information in accordance with this policy. Children under the age of 18 must obtain parental consent prior to using our Services. If we change our Privacy Policy, we will notify you including by posting those changes or the amended Privacy Policy on the Site. We reserve the right to amend this Privacy Policy at any time. To the fullest extent permissible under applicable law, your continued use of the Services, Game or Site, including making any purchases or orders, shall constitute your acknowledgement and acceptance of the changes made to this Privacy Policy. If you disagree with our data collection and processing practice, we encourage you not to play our Game. If you play our Game, however, the information listed below is necessary for the Game to function. You can, at any time after you have created your Game account, request that we delete your account. If you do so, we will delete all information that we have collected from you.
INFORMATION COLLECTION
This Privacy Policy concerns the information that you may provide us with (for example when you set up an account for the Game or play the Game) and that we may collect from you automatically when you access or play the Game. This information is necessary for us to provide the Game up to your expectations, as we promised, and to protect us and other players against harm from others. If you fail to provide information listed below, it could impact some features and/or functionalities of our Services. The collection of information is carried out in two stages.
- Information you provide with us can be “Personal” or “Non-Personal” information. "Personal Information" means specific identifiable information about an individual which may be used to identify, contact, or locate that person (e.g., name, username, password, mailing address, Device ID, email address or phone number). "Non-Personal Information" means information that, by itself, does not identify a specific individual or entity (e.g., demographic information, usage data or downloads). When you or one of your representatives send an email or initiate another type of communication with us, we have the right to retain the communication to process your requests, respond to them and improve our services. We will not collect information if your communication with us does not relate to our Game, and we will delete this information as soon as we have resolved your request.
- When you use our Services, we may automatically receive and record information from your device and browser, including your IP address (address used to connect your computer to the Internet, computer, and connection information such as browser type, version, and time zone setting, browser plug-in types and versions, operating system, and platform), IDFA - the Identity for Advertisers (for iOS devices), and GAID - Google Advertising ID (for Android devices). If you access the Services through any App Platform or interact with any App Platforms or any other plug-in social media in the Services (Facebook etc.) we may receive information from your respective social media or App Platform account, including your account information, photo and any information defined as public pursuant to the policies of such App Platform and your settings in the respective App Platform. Besides, we also collect cookie information, search history, device ID, Android ID, your regional and language settings, the physical location of your device (if you have permitted your mobile or other location-aware device to transmit location data), network status (Wi-Fi/3G), and software and hardware attributes. We may use your location (city) (if you have permitted your mobile or other location-aware device to transmit location data) to learn how to adjust and personalize your use of the Services. Our systems may automatically record and store technical information regarding the method and nature of your use of the Services, including without limitation which pages of the Services our visitors view, what games they played, their score, game advancement, any actions in-game, virtual content gained and impressions.
USE AND PROTECTION OF INFORMATION COLLECTION
We may use and store your information to provide, administer, maintain, and improve our Game, analyze user activity of our Game, personalize experience of the Game, provide you with support regarding our Game, to manage your Game account to enforce our rights and the rights of other users of the Game, to maintain a safe Game and player community, to comply with our legal obligations, or to prevent imminent and serious bodily harm to a person. Identifiers listed down below are collected herein for the additional purposes: monitor system performance, analyze internal business, contact you about promotional and marketing activities, frequency capture, attribution, number of unique users’ estimation, advertising fraud detection, and debugging. Additionally, we may share your Personal (1.a.), non-Personal (1.a.), and Information we collect automatically (1.b.) (hereinafter referred to as “Information”) for the purposes described in this Privacy Policy to our subsidiaries or successors and affiliated third parties. We take commercially reasonable precaution to prevent such subsidiaries, successors and affiliated third parties from disclosing Information. However, we cannot guarantee that they will not disclose your Information, nor we can guarantee or ensure perfect security. Accordingly, we take no liability for any disclosures of Information due to errors in transmission, unauthorized third-party access, or other acts of third parties, or acts or oversight beyond our reasonable control.
Onyx Games does not sell, and generally does not disclose, your Information to third parties without your consent. Except, parents have the right to consent to collection and use of the specified information from their children without also consenting to its disclosure to third parties, as Onyx Games does not share nor will knowingly collect information from your children under the age of 13 years old. If we discover that some of our Information originates from children under 13 years old, we will delete said Information immediately. Additionally, we will not knowingly contact or engage communication with children under the age of 13 without parental consent. If you are a parent or legal guardian and you are aware that your child has given us Information, contact us as soon as possible. Onyx Games may disclose information you provide to respond to court orders, requests from authorities, subpoenas, and other legal processes, and to establish/exercise Onyx Games' legal rights.
Onyx Games may also disclose your information to defend against legal claims when Onyx Games believes that disclosure is necessary to protect Onyx Games' rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
As Onyx Games continues to develop, we may reorganize as a business entity, acquire entities, subsidiaries, or business units, or enter joint ventures with third parties. Any information you provide may be one of the transferred business assets (subject to any pre-existing privacy notice unless you consent otherwise). If all or majority of Onyx Games' assets are acquired or Onyx Games merges with a third-party, your information will likely be one of the transferred assets. You understand and agree that Onyx Games reserves the right to transfer any information collected from you in the case of any such transfer. In such event, Onyx Games will use reasonable efforts to notify you before Information about you is transferred and becomes subject to a different privacy policy.
We retain Information if it is necessary for us to fulfil the purposes outlined in this Privacy Policy. Additionally, we may retain your Information for an additional period as is permitted or required to (to comply with our legal obligations, resolve disputes, and enforce agreements etc.). If required by applicable law, we shall delete your information when the information is no longer necessary or requested to do so. When you terminate your Game account, your information is deleted along with your account unless otherwise stated in Privacy Policy.
